General terms and conditions

You confirm that you have signed an electronic waiver form before attending any lesson at Aerial Arts Academy ("AAA"). If for any reason this has not been possible, you acknowledge and confirm that by booking any membership or session with AAA, you agree to the terms and conditions below.

To participate in our activities, including but not limited to pole and aerial (the "Activities"), organised by AAA, its sister companies, owners, directors, volunteers, employees, independent contractors, insurers, facility operators and any other persons acting on its behalf, you agree as follows:

You are: aged 18 or over and wish to participate in the Activities; or the parent/legal guardian of participants under 18 ("Participants") and you give permission for them to take part; or, if you are not the Participant's parent/legal guardian, you confirm you are 18 or over and have authority from their parents/legal guardians to agree to this waiver.
You are responsible for the Participants and will ensure that you and they comply with AAA rules, use of facilities and conduct, and carry out the Activities in line with AAA rules and any safety rules and instructions given before and during the Activities.
You will ensure the Participants wear any safety equipment provided by AAA in accordance with its safety instructions, and that you and the Participants follow the directions of AAA personnel at all times.
To the best of your knowledge and belief, you and the Participants are in good health and able to take part in the Activities, and doing so would not be detrimental to your or their health, safety, comfort, wellbeing or physical condition, or to the health and safety of others. You will tell us immediately if your circumstances change.
You acknowledge that AAA has not given you or any Participant medical advice about your or their physical condition and ability to take part in any Activities.
You acknowledge that the Activities may be physically demanding and that there are risks of injury, including serious bodily injury, permanent disability, paralysis and loss of life. If you or any Participant suffer an accident, loss or damage while taking part in an Activity or at AAA classes, AAA will not be liable for any direct or indirect loss, damage or injury arising from it (except for death or personal injury caused by AAA's negligence), and you waive all claims against AAA in this regard for yourself and on behalf of the Participants.
You agree to indemnify AAA against all claims made by any other person in respect of any injury, loss or damage arising from your or a Participant's failure to comply with AAA's terms and conditions, class rules or safety instructions.
By taking part in AAA Activities, you grant AAA the irrevocable right to photograph and/or record you and/or the Participants in connection with AAA and to use those photographs and recordings for any purpose, including advertising and promotion, without compensation. If you do not want AAA to have these permissions, please confirm this in writing to a member of AAA staff before taking part.
You confirm that neither you nor any Participant is under the influence of drugs or alcohol.
If we take no action over a breach of this agreement, or give you extra time to pay or comply, it will not stop us enforcing these terms strictly at a later date.
There may be occasions when we have to close or cancel classes. We will do our best to let you know in advance unless the problem is urgent or an emergency, and will keep closures to a minimum.
We will not be liable for any failure or delay in performing our obligations under these terms caused by any event outside our reasonable control.

This agreement is governed by English law. We may end this agreement with immediate effect on notice if you breach AAA rules.

Your personal information

We will use the personal information you give us to provide your membership services, process your membership payments and tell you about relevant products or services from AAA. You can stop receiving these at any time by contacting us. See our privacy policy for full details.

Prices

From time to time we may need to increase our prices. We will give you at least one full month's notice of any price increase, making clear when it takes effect and what the new price will be.

Memberships

We operate a 24-hour cancellation policy. If you cancel a class within 24 hours of the start time (unless agreed with us), you will lose that class credit.

Pay as you go and class packs

Class package time limits start from the date of purchase.
Pay as you go classes, class packages and private classes cannot be transferred to anyone else.
Pay as you go and class pack classes are non-refundable.
You must use the credits in your class package within the period stated at purchase. Unused credits are non-refundable.
If you cannot attend a class, you need to cancel at least 2 hours beforehand to avoid losing it. Cancellations within the 2-hour window mean the class is forfeited.
Classes, privates and workshops are non-transferable.
